Rule 4
Procedure for obtaining certificate of Nepali citizenship based on birth:

(1) According to sub-section (1) of section 4 of the Act, a Nepali citizen who has completed sixteen years of age who wishes to obtain a certificate of Nepali citizenship based on birth should attach the following documents to the concerned chief district officer, Schedule-1 The application should be submitted in the following format –
(a) The recommendation made by the concerned local body to reveal the fact that the applicant was born in Nepal and has been permanently residing in Nepal,
(b) Land owner registration proof of his or his family's name or certificate of Mohiyani rights or household proof or proof that his or his father's or mother's name is included in the voter's list prepared by the Election Commission. Explanation :- For the purpose of this section, "family" means father, mother, stepmother, son, unmarried daughter and son-in-law who live separately or live separately.
(2) According to sub-rule (1), a person who wants to obtain a certificate of citizenship must submit an application to the Chief District Officer before the election of the Constituent Assembly.
(3) According to sub-section (4) of section 8 of the Act, a certificate of Nepalese citizenship may be issued to a person who cannot submit the evidence as per sub-rule (1) with the application -
(a) The land acquired by the local residents who have obtained the certificate of Nepali citizenship in the format as per Schedule-5 to the representative of the local body in order to disclose the fact that the applicant was born in Nepal and has been permanently residing within the borders of Nepal,
(b) Three Nepali citizens living in the respective ward who have got a certificate of Nepali citizenship have given their identification in the format as per schedule-6 at the place of birth. However, if the person who identifies the officer who recommends citizenship or grants citizenship is found to have done questionable identification, such officer can investigate further.
(4) Received within the time period as per sub-section (3) of section 4 of the ActRegarding the grievances, the chief district officer should take a decision within one month from the date of registration of such petitions.
(5) Upon investigation of the application received under sub-rule (1) or (3), if the applicant is found to be eligible to receive a certificate of Nepali citizenship based on birth, he/she may be issued a certificate of Nepali citizenship based on birth.
(6) According to sub-rule (3), the list of persons who have applied to obtain a certificate of Nepali citizenship shall be made public on the same day.
